What Is the UK Scale-up Visa Application?

The UK Scale-up Visa is one of the most distinctive work visa routes in the UK immigration system. Launched in August 2022, it was designed specifically to help fast-growing UK businesses attract skilled international talent without the ongoing sponsorship burden that the Skilled Worker route places on employers. The Scale-up route is a hybrid: workers are sponsored for the first six months of employment, then become free to work for any employer, change role, or even become self-employed, all without applying for a new visa. For workers, the appeal is clear — the Scale-up Visa offers genuine career flexibility in the UK that no other sponsored work route provides.

From 22 July 2025, the salary threshold increased to £39,100 per year (raised from £34,600), or the going rate for the occupation, whichever is higher. From 8 January 2026, the English language requirement increased to CEFR Level B2. The route leads to ILR after five years of continuous lawful residence, subject to meeting PAYE earnings conditions. Scale-up Visa holders are not subject to the Immigration Skills Charge, making it significantly more cost-effective for employers than Skilled Worker sponsorship.

For employers, accessing the Scale-up route means first demonstrating that the business qualifies as a scale-up. Under the standard pathway, this means showing annualised growth of at least 20% per year in either turnover or employee headcount over three years, with at least 10 employees at the start of that period. The Home Office assesses this automatically using HMRC data. For newer businesses that cannot yet meet this test, the endorsing body pathway offers an alternative route to a Scale-up Sponsor Licence.

After 6 Months: Complete Freedom to Change Employer

The Scale-up Visa's defining feature is its two-phase structure. During the first six months, workers must remain with the sponsoring employer in the specified role at £39,100+. After six months, the sponsorship obligation ends entirely. Workers can move to any employer, take a different role, or become self-employed, all without a new visa application. No other sponsored UK work route offers this freedom. Compare to the Skilled Worker Visa, where every change of employer requires a new Certificate of Sponsorship.

Updated July 2025: Salary Threshold Now £39,100

For Certificates of Sponsorship assigned on or after 22 July 2025, the minimum salary for the Scale-up Visa is £39,100 per year, raised from the previous £34,600. This is still lower than the £41,700 Skilled Worker threshold. The salary applies during the initial six-month sponsored period and must also be evidenced via PAYE for the unsponsored extension and ILR applications.

B2 English from January 2026 (Raised from B1)

From 8 January 2026, all new Scale-up Visa applicants must demonstrate CEFR Level B2 English, raised from the previous B1 requirement. Evidence can be provided via an approved Secure English Language Test (SELT) at B2, a qualifying degree taught in English, or a nationality exemption. Transitional protection applies to those already in the Scale-up route before 8 January 2026 who are extending, they continue to be assessed at B1.

Eligibility Assessment

We carry out a full eligibility assessment from both the worker and employer side. For workers, we confirm occupation code eligibility, salary threshold compliance (£39,100+), and English language level. Obtain the Licence and Certificate of Sponsorship

For businesses not yet holding a Scale-up Sponsor Licence, we guide you prepare and submit the full licence application, advise on HR system requirements for the six-month compliance period, and guide the business through the SMS setup. Once the licence is granted, we assist with assigning the Certificate of Sponsorship to the worker, confirming the role, salary, and SOC code are correctly completed.

Prepare and Submit the Visa Application

We help you prepare the complete Scale-up Visa application bundle: Certificate of Sponsorship reference, passport, B2 English evidence, financial maintenance evidence, and any TB certificate required. 6-Month Compliance, Extension, and ILR

We advise both the employer and worker on obligations during the six-month sponsored period. After six months, we confirm the worker has entered the unsponsored phase correctly. When the initial two-year permission approaches its end, we prepare the three-year unsponsored extension using PAYE earnings evidence. We also assist with the ILR application after five years and advise businesses approaching the four-year licence cap on transitioning to a Skilled Worker Sponsor Licence.

What is the UK Scale-up Visa and how is it different from the Skilled Worker Visa?

The Scale-up Visa is a hybrid work route for fast-growing UK businesses. Workers are sponsored for the first six months, then become fully unsponsored: free to change employer, change role, or become self-employed without any new visa. The Skilled Worker Visa requires ongoing sponsorship throughout employment, and every change of employer requires a new Certificate of Sponsorship. What is the salary threshold for the UK Scale-up Visa?

£39,100 per year from 22 July 2025, raised from the previous £34,600, or the going rate for the specific occupation code, whichever is higher. The salary must be paid during the initial six-month sponsored period. For the three-year unsponsored extension, PAYE earnings of at least £39,100 must be demonstrated for at least 50% (12 months) of the initial two-year period. The £39,100 threshold is lower than the £41,700 required for the Skilled Worker route.

What is the English language requirement for the Scale-up Visa?

Does my business need a Sponsor Licence for the Scale-up route?

Yes. A Scale-up Sponsor Licence (Temporary Worker licence) is required to assign Certificates of Sponsorship on the Scale-up route. To obtain the licence, the business must qualify as a scale-up. There are two pathways: the standard 20% annualised growth pathway (HMRC-verified) and the endorsing body pathway for newer businesses. Does the Scale-up Visa lead to ILR and can my family come with me?

Yes on both counts. The Scale-up Visa leads to Indefinite Leave to Remain after five continuous years, subject to PAYE earnings conditions. Eligible dependants can accompany or join the main applicant throughout the route. Importantly, the July 2025 RQF Level 6 restriction that limits Skilled Worker dependants does NOT apply to the Scale-up route. Scale-up visa holders at any occupation level can bring their family.
